Colorado’s hands-free phone law will take effect on January 1, 2025

Prohibited actions

Drivers cannot hold or use a mobile device while driving, including for voice calls or GPS. Drivers under 18 cannot use a phone for any reason, except in emergencies.

Permitted actions

Drivers can use hands-free accessories, such as:

  • CarPlay and Android auto
  • Car speaker phone systems
  • Dashboard mounts
  • Bluetooth headsets

Penalties

The first offense is a $75 fine and two license suspension points. Repeat offenders face higher fines and more license points. First-time offenders can have the charge dismissed if they buy a hands-free accessory.

Exemptions

The law does not apply to:

  • Individuals reporting emergencies
  • Utility workers
  • Code enforcement officers
  • Animal protection officers
  • First responders
  • Individuals in parked vehicles
  • Commercial drivers operating a commercial vehicle

The law expands on Colorado’s existing ban on texting while driving. It’s intended to reduce distracted driving crashes and enhance road safety.

Senate Bill 24-065 defines “Mobile electronic device” to mean a handheld or portable electronic device capable of providing voice communication between two or more persons, amusement, or the wireless transfer of data.

Colorado Revised Statutes 42-4-239 Section D (I) states “Mobile electronic device” does not include:

  • (A) a radio, citizens band radio, or citizens band radio hybrid;
  • (b) a commercial two-way radio communication device or its functional equivalent;
  • (c) a subscription-based emergency communication device;
  • (d) a prescribed medical device;
  • (e) an amateur or ham radio device; or
  • (f) systems that are designed for and installed within the vehicle’s electronics, such as an in-vehicle security, navigation, communications, or remote diagnostics system.
